TERMS AND CONDITIONS

1. SCOPE OF SERVICES

1.1 Medical Consultations – We provide professional consultations conducted by licensed physicians, including but not limited to:

  • Online Health Consultations

  • SHAPE Weight Loss Programs

  • General medical follow-ups for weight and wellness
     

1.2 Medical Treatments & Aesthetic Procedures – We offer weight loss and body contouring treatments such as Emsculpt NEO, Exilis, and mesolipo, subject to physician evaluation and medical appropriateness.

1.3 Wellness Products & Medications – We make available certain supplements and prescription-only medicines (e.g., GLP-1 therapies such as Saxenda), which are dispensed only after physician evaluation and prescription when medically appropriate.

2. PROFESSIONAL MEDICAL ADVICE
 
2.1 Physician Consultations – All medical consultations provided by Jan Medical Group constitute professional medical advice given by duly licensed physicians. Clinical recommendations, prescriptions, and treatment plans are based on the information you disclose. It is your responsibility to provide complete and accurate medical history, including current medications and allergies.
 
2.2 Nutrition and Wellness Guidance – In addition to physician consultations, we also provide services through qualified nutritionists and body advisors. These sessions are intended to complement medical treatment by offering personalized nutrition, fitness, and wellness guidance.
 
2.3 Distinction of Services –

  • Medical consultations with our physicians involve diagnosis, prescription, and treatment planning, and are legally recognized as medical advice.

  • Consultations with nutritionists and body advisors are advisory in nature and do not replace medical evaluation or treatment by a licensed physician.
     

2.4 Limitations – While our nutritionists and body advisors are trained professionals, they are not licensed medical doctors. Clients are encouraged to follow their guidance as part of a holistic program but should not rely on it as a substitute for medical consultation where required.
 
2.5 Disclaimer of Outcomes – Whether provided by physicians, nutritionists, or body advisors, treatment and program outcomes vary depending on individual health status, compliance, and lifestyle. No guarantee of results is made.

3. PATIENT CONSENT & ACKNOWLEDGEMENT

3.1 By availing our services, you acknowledge and consent to:

  • Undergoing medical evaluation and treatment by our physicians.

  • Receiving information on the risks, benefits, and alternatives of the proposed treatment.

  • Having the opportunity to ask questions, all of which have been answered to your satisfaction.
     

3.2 You further acknowledge that:

  • Certain treatments and medications carry inherent medical risks.

  • Failure to disclose relevant health information may compromise treatment safety.

  • You voluntarily assume these risks and release the Clinic from liability except in cases of proven negligence or willful misconduct.
     

4. TELEMEDICINE SERVICES

4.1 We provide consultations both in-person and online. Teleconsultations are subject to inherent limitations, including absence of physical examination.

4.2 You agree that prescriptions may only be issued when clinically appropriate.

4.3 By booking a teleconsultation, you accept these limitations and agree to follow the physician’s instructions, including recommendations for in-person follow-up if required.

5. ELIGIBILITY

5.1 You must be at least 18 years old to use our services. Minors may only be treated with parental or legal guardian consent.

5.2 Certain services, especially prescription medications, require additional screening and physician clearance.

6. APPOINTMENTS, FEES, AND PAYMENTS

6.1 Booking an appointment constitutes an agreement to receive services under these Terms.

6.2 Prices are subject to change without prior notice. Final fees will be confirmed at booking.

6.3 Payments are due before or at the time of service. Deposits may be required for specific services or promotional packages.

6.4 Cancellations or rescheduling must be made at least 24 hours in advance. Late cancellations and no-shows may be charged in full.

7. PRODUCTS AND PRESCRIPTIONS

7.1. General Policy
All sales of prescription medications (including GLP-1 products and injection pens) and wellness products are final and non-refundable once dispensed, shipped, or picked up.

This policy is in place to:

  • Protect patient safety.

  • Comply with state and federal laws regarding the handling of prescription medications and ingestible products.

  • Maintain product integrity and prevent diversion.
     

7.2 Prescription Products (GLP-1, Injection Pens, Other Medications)
       General Rule: All prescription medication sales are final.

  • Conditional Returns: A return may be considered only if ALL of the following conditions are met:

  • The product was dispensed in error by the clinic (wrong medication, strength, or quantity).

  • The product is unopened, sealed, and in its original packaging.

  • The product has been stored appropriately (as verified by the clinic staff).

  • The return request is made within 72 hours of pickup or delivery.

  • Clinic Discretion: Approval of any return is solely at the clinic’s discretion, and the remedy will generally be exchange for the correct product — not a refund.

    No Returns Accepted for:

  • Opened or partially used medications.

  • Medications not stored as directed (e.g., refrigeration lapses).

  • Medications beyond 72 hours of patient possession.

  • Situations involving patient preference, side effects, or lack of desired results.
     

7.3 Vitamins, Nutraceuticals, and Other Wellness Products

  • Unopened Products: May be eligible for return within 7 days of purchase with original receipt and intact packaging.

  • Opened or Used Products: Not eligible for return or refund, regardless of reason (including dissatisfaction with taste, tolerance, or results).

  • Special Orders: Custom or special-order products are non-returnable and non-refundable.
     

7.4 Defective or Damaged Products

  • If a product is visibly defective or damaged at the time of delivery/pick-up, it must be reported immediately (within 24 hours) to the clinic staff.

  • At the clinic’s sole discretion, a replacement may be provided.

  • No refunds will be issued — replacement is the only remedy available.
     

7.5 No Refunds for Treatment Outcomes

  • The effectiveness of GLP-1 products, vitamins, and wellness products varies by patient.

  • The clinic does not guarantee specific outcomes. Purchases are non-refundable based on treatment results, side effects, or patient preference.
     

7.6 Payment Disputes

  • Patients authorize charges at the time of purchase.

  • Attempted chargebacks or payment disputes may result in suspension of services and collection actions.
     

7.7 Right to Refuse Return or Refund
The clinic reserves the right, in its sole discretion, to decline any return or refund request that does not strictly comply with this policy.

8. REFUNDS AND RETURNS

8.1 Services – Refunds are granted only if the Clinic cannot render the booked service or in cases required under the Consumer Act of the Philippines (RA 7394).

8.2 Medications & Supplements – For safety reasons, all medications and supplements are non-refundable and non-returnable once dispensed.

8.3 Prepaid Packages – Unused portions of prepaid treatment packages may be credited or refunded, subject to evaluation and applicable deductions.

9. CLIENT RESPONSIBILITIES

9.1 You agree to:

  • Provide truthful and complete information during consultations.

  • Follow all prescribed treatment plans, medication instructions, and aftercare advice.

  • Use our website and services for lawful purposes only.
     

9.2 Non-compliance may affect treatment outcomes and safety.

10. LIMITATION OF LIABILITY

10.1 To the fullest extent permitted by law, Jan Medical Group shall not be liable for indirect, incidental, or consequential damages from the use of our services or products.

10.2 Liability, if any, is limited to the amount actually paid for the specific service or product in question.

10.3 Nothing herein excludes liability for proven negligence, willful misconduct, or obligations required by law.

11. DATA PRIVACY AND PROTECTION

11.1 We process personal data in compliance with the Data Privacy Act of 2012 (RA 10173).

11.2 Your personal and health information will be used only for legitimate healthcare purposes and kept confidential, except where disclosure is required by law or authorized by you.

11.3 By using our services, you consent to such collection, use, and secure storage of your personal and health information.

12. INTELLECTUAL PROPERTY
 
12.1 All original content on janmedicalgroup.ph — including but not limited to our name, logo, branding, clinic information, service descriptions, and photographs produced by Jan Medical Group — is the property of Jan Medical Group and is protected by copyright, trademark, and other intellectual property laws.
 
12.2 Certain visual materials on the website may be sourced from royalty-free or copyright-free image libraries. Such materials remain subject to the license terms under which they were provided and are not claimed by Jan Medical Group as original works.
 
12.3 Except as permitted by law, no material from janmedicalgroup.ph may be copied, reproduced, distributed, republished, downloaded, displayed, posted, or transmitted in any form or by any means without prior written consent from Jan Medical Group.
 
12.4 Clients and users are granted a limited, non-exclusive, non-transferable license to access and view the website content for personal, non-commercial use only. Any unauthorized use of our content or branding may result in legal action.

13. GOVERNING LAW AND JURISDICTION

13.1 These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

13.2 Any disputes shall first be attempted to be resolved amicably through mediation or arbitration.

13.3 If unresolved, disputes shall be brought exclusively before the proper courts of Quezon City, Philippines.

13.4 Nothing in this clause shall deprive clients outside the Philippines of mandatory protections granted under the consumer protection laws of their country of residence.

14. AMENDMENTS

We reserve the right to update these Terms and Conditions at any time. Changes will be effective upon posting with a revised “Last Updated” date.
